We Hope This is True!

Fox News is reporting that the remaining charges in the non-(and never was a)-rape case involving the three Duke lacrosse team members may be dismissed within the next few days. Oh, happy days.

And note that dismissal of the wrongfully brought charges is an essential element to a suit for wrongful or malicious prosecution.

The source is a writer on lacrosse named Paul Caulfield, who said. There is no case here and they will be hearing a dismissal in the coming days. Let's hope he knows what he's talking about.

In related news, the prosecutor formerly in charge, Mike Nifong, had his hearing on charges of multiple ethics violations arising from his actions on this case he no longer handles scheduled for June 12, 2007. That's pretty quick. There's still no trial set in the Duke lacrosse case, even now.

So, Duke lost a season; Mike Evans graduated; neither Reade Seligmann nor Collin Finnerty are on the roster so I presume they have not returned to school; I also presume the parents of these three have spent thousands of dollars on legal fees; Mike Pressler, from my hometown, was forced to resign from his dream job; the story that the charges will be dropped is being denied by the NC AG's office (go to www.laxpower.com for links to articles--Roger, please teach me how to do this); and Mike Nifong's trial on ethics violations begins June 12.

I wonder what the "victim" is up to.
 
Mark, I don't think he'll ever be charged with a crime and unless something extraordinary is revealed, he will be immune from civil suit (Durham county, on the other hand, may not be so lucky). I'm not ready to ascribe evil intent to the guy, he just did a really bad job with mistake upon mitake upon mistake, for which he may well lose his license. I think the three guys will recover and will get money for their lawyers and their non-economic damages and everyone who knows this story will not think worse of them but will see them as victims of our human run system of justice, but Duke, never my favorite school, is lessened in the eyes of nearly everyone, probably for a long time and your friend is another victim. The so called victim is about to have a baby, isn't she? Her third I believe. I'll email you the code for a link.
